1. Acceptance of Terms

By accessing and using the services of 4JAKS, located at Av. del Mediterráneo, Benidorm, Spain, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services or website.

2. About 4JAKS

4JAKS operates Benidorm's drinks exchange bar and entertainment venue. We are a registered business operating in accordance with Spanish commercial law.

3. Trademark and Intellectual Property

"DRINKS EXCHANGE" is a registered trademark owned exclusively by 4JAKS. All rights reserved.

The following are protected intellectual property of 4JAKS:

• The term "DRINKS EXCHANGE" and its variations
• 4JAKS logo, branding, and design elements
• Website content, text, images, and videos
• Business methods and operational concepts

Unauthorized use, reproduction, or distribution of our trademarks or intellectual property is strictly prohibited and may result in legal action.

4. Services Provided

4JAKS provides:

• Bar and beverage service with dynamic pricing ("drinks exchange" concept)
• Bottomless brunch packages
• Private event hosting and entertainment services
• Premium add-on entertainment options
• A Night Out with The Benidorm Fanatic experience (separate terms apply)

5. Booking and Reservations

5.1 Booking Requests

All booking requests through our website are subject to availability and confirmation by 4JAKS. A booking is not confirmed until you receive written confirmation from us via email or WhatsApp.

5.2 Deposits and Payment

A deposit may be required to secure your booking. Full payment terms will be communicated upon booking confirmation. All prices are in Euros (€) and include applicable Spanish VAT (IVA).

5.3 Cancellation Policy

• Cancellations made 7+ days before the event: Full refund
• Cancellations made 3-6 days before: 50% refund
• Cancellations made less than 3 days before: No refund
• No-shows: No refund

5.4 Modifications

Changes to bookings must be requested at least 48 hours in advance and are subject to availability. We reserve the right to charge a modification fee.

6. Age Restrictions

In accordance with Spanish law:

• Entry: Under 18s are permitted when accompanied by a parent or legal guardian
• Alcohol: You must be 18 years or older to purchase or consume alcoholic beverages
• Booking: The person making a booking must be 18 years or older
• Supervision: Adults are responsible for supervising any minors in their group

We reserve the right to request valid photographic identification to verify age. Anyone unable to provide valid ID will be refused service of alcohol. Unaccompanied minors may be refused entry at management's discretion.

7. Customer Conduct

Customers must:

• Behave in a respectful and lawful manner
• Not engage in violence, harassment, or discriminatory behavior
• Not bring outside food or beverages onto the premises
• Follow all instructions from 4JAKS staff
• Comply with Spanish health and safety regulations

We reserve the right to refuse entry or service to anyone, and to remove customers who violate these terms, without refund.

8. Limitation of Liability

4JAKS shall not be liable for:

• Loss or damage to personal property
• Injuries not caused by our negligence
• Consequences of customer intoxication or irresponsible behavior
• Events beyond our control (force majeure, natural disasters, government restrictions)

Our liability is limited to the amount paid for the specific service in question, except where prohibited by Spanish law.

9. Responsible Service of Alcohol

In accordance with Spanish law, we reserve the right to refuse service of alcohol to any person who appears intoxicated or unable to manage their consumption responsibly. Our staff are trained in responsible alcohol service and their decisions are final.

10. Entertainment Services

For bookings that include entertainment services (strippers, performers, etc.):

• All performances comply with Spanish decency laws
• Customers must treat performers with respect
• Physical contact with performers is prohibited unless explicitly permitted
• Photography/recording of performers requires their consent
• Entertainment services are subject to performer availability

11. Pricing and "Drinks Exchange"

Our unique "DRINKS EXCHANGE" concept features dynamic pricing:

• Drink prices fluctuate based on demand and other factors
• Displayed prices are indicative and may change
• The price at the time of order is the price you pay
• We reserve the right to modify prices at any time
• All prices include Spanish VAT (IVA) unless otherwise stated

12. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to: natural disasters, government restrictions, public health emergencies, strikes, or other events constituting force majeure under Spanish law. In such cases, we will offer rescheduling or a full refund.

13. Governing Law and Jurisdiction

These Terms and Conditions are governed by Spanish law. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Benidorm, Spain, or the courts of the customer's domicile at the customer's option, in accordance with Spanish consumer protection law.

14. Consumer Rights

As a consumer in Spain, you have specific rights under the Spanish Consumer Protection Act (Real Decreto Legislativo 1/2007). These rights include:

• Right to accurate information about services and prices
• Right to fair commercial practices
• Right to file complaints with consumer protection authorities
• Right to dispute resolution

15. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable under Spanish law, the remaining provisions shall continue in full force and effect.
